An expert group is meeting Sunday at the World Intellectual Property Organization, on the eve of a weeklong session of the WIPO committee on genetic resources and traditional knowledge. The expert group will address the most divisive issues in the discussions of the committee in charge of finding solutions to protect genetic resources, traditional knowledge and folklore against misuse and misappropriation.
Faced with a longstanding lack of progress at the World Trade Organization and the World Intellectual Property Organization on the protection of genetic resources and traditional knowledge, some developing countries are examining the possibility of moving outside the multilateral system toward a plurilateral agreement with like-minded countries. The World Intellectual Property Organization committee on trademarks concluded early today with plans for further work and a full week session for the next meeting. Member states are called into action to provide inputs so that the WIPO secretariat can come up with questionnaires on the protection of new technological designs, such as icons, and on the protection of geographical indications. Another issue for which member states are asked to contribute inputs in how to protect country and geographical names.
After a difficult start to the week, World Intellectual Property Organization delegates on 23 March agreed on a revision of a set of articles of a potential treaty preventing the misappropriation of genetic resources through IP protection. The revised text will serve as a basis for further discussions at the next session of the WIPO committee dealing with the protection of genetic resources, in June. After the first suggested revision of potential treaty articles preventing the misappropriation of genetic resources was sent back to the drawing board this week, the second revision emerged today, for consideration by the World Intellectual Property Organization member states. Separately, a proposal by the committee chair to establish an expert group to meet prior to the next session of the committee meeting was positively received.
