Late tonight on the last day of the annual World Intellectual Property Organization General Assembly, delegates agreed on a mandate and a work programme of the committee seeking ways to protect genetic resources, traditional knowledge, and folklore from misuse and misappropriation. Meanwhile, no agreement was found on the convening of a high-level negotiating meeting for a new treaty on industrial designs.
A new draft emerged today, the last day of the negotiations, on renewal of the mandate of a World Intellectual Property Organization committee on protection of genetic resources and traditional knowledge.
The intellectual property committee of the World Trade Organization is meeting next week with several notable items on the agenda, including some reviving earlier negotiations. Among topics for discussion on intellectual property and innovation is a focus on inclusive innovation and micro, small and medium-sized enterprises. Also, India also submitted a series of questions for the European Union about goods in transit, echoing an earlier WTO dispute. And separately, some countries are holding a workshop on geographical indications and traditional knowledge.
This morning no breakthroughs were reported by delegates chairing informal meetings to reach consensus before the end of the annual World Intellectual Property Organization General Assembly tomorrow. Agreement still has to be reached on the most political issues, such as the budget, the mandate of the committee on genetic resources and traditional knowledge, and where the next WIPO field offices will be hosted. Also under discussion is the composition of one of WIPO’s governing bodies, challenged by the Asia and Pacific Group, which wants more seats.
Delegates rushing against time to find agreement on the next mandate of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC) are considering a third draft decision, issued this morning.
With three days remaining at the annual World Intellectual Property Organization General Assembly, delegates are still seeking agreement on the 2018/2019 budget, the mandate of the committee on the protection of genetic resources and traditional knowledge, and an update to the international treaty on design law. A number of decisions have however been approved, as WIPO committees reported on their activities.
The United States and Japan have submitted a joint proposal for the next mandate of the World Intellectual Property Organization committee on the protection of genetic resources and traditional knowledge, whose mandate must be decided this week. The new proposal comes on top of proposals from the African Group and the European Union. If there is a large consensus saying the committee should continue its work, the objectives of the committee and the way to achieve them differ widely.

The annual World Intellectual Property Organization General Assembly opened today for 10 days during which delegates have to agree on budget, and on several decisions which might lead to more normative activities on the part of the organisation, although impatience is not equally shared depending on subjects. Separately, the United States submitted a new proposal on the budget, and the European Union tabled a proposal on a new mandate for the WIPO genetic resources and traditional knowledge committee.
The annual UN World Intellectual Property Organization General Assemblies kick off this week for ten days during which delegates will have to find consensus on the budget for the next biennium, 2018/2019. Also on the agenda is the potential renewal of, and a proposed work programme for, the committee on genetic resources and traditional knowledge. WIPO delegates will also decide if they want to convene a high-level final negotiation for a design law treaty, and provide guidance on the work of the WIPO committee on copyright. A decision on which countries should host the next WIPO field offices has also been left to the General Assembly.
The government of Japan, in partnership with the African Region Intellectual Property Organisation (ARIPO), has begun implementation of a project meant to train 1,000 people across Africa in intellectual property systems. The World Intellectual Property Organization also plays a role.
China and the European Union appear to be on track to complete a deal on geographical indications that could include protection of some 100 products each from the EU and China. Comments have been received on the proposed list and are undergoing translation. Among them, a United States lobby group said the list for China to protect unfairly includes several generic food names that should not belong solely to the EU.
