US Challenges For Biotech In 2015 – An Interview With BIO’s Hans Sauer

The biotechnology industry is closely watching developments in the United States that could impact the industry in 2015. These include the regulatory framework for biosimilars, possible patent legislation, post-grant review procedure, and the consequences of the recent Supreme Court ruling banning the patenting of human genes. Hans Sauer, Deputy General Counsel for Intellectual Property at the Biotechnology Industry Organization (BIO), recently spoke with Intellectual Property Watch’s Catherine Saez. Sauer was asked to lay out the main developments to watch in the coming year.

Biosimilars Present Opportunity, Challenge For Developing Countries, UNCTAD Group Says

Biosimilars are a hot topic. Beyond the colossal profits foreseen by some, drawing a lot of interested parties into the game, developing countries mean to play a role in this new frontier. However, biosimilars - close copies of biopharmaceutical products - are difficult and very costly to produce and come as a challenge to the generic industry used to duplicating small molecules. And some warn about differences in regulatory requirements, which could effectively boot developing countries out of the global market.

Review, and possibly reform, of the European Union copyright system tops the list of “hot” European intellectual property issues this year. The new European Commission has made modernising copyright rules a major priority, while fresh debate has broken out over the need for levies on digital copying devices to remunerate rights holders.

Meanwhile ongoing unrest between European Patent Office (EPO) staff and management looks likely to continue, as do efforts to finalise the unitary European patent and Unified Patent Court. EU legislation to protect trade secrets could be adopted and trademark law updated. In addition, several important IP-related decisions are expected from the European Court of Justice (ECJ).

WTO Back At The Discussion Table On GI Register

An informal meeting is scheduled to take place on 12 December at the World Trade Organization on a multilateral register for geographical indications of wines and spirits. The meeting is expected to discuss how to move the work in the negotiations, and how to reflect it in the post-Bali work programme, according to a source.

WIPO: New Proposal On Disclosure Requirement In Design Applications

On the first day of the World Intellectual Property Organization committee on trademarks and designs the focus was on a proposal from the African Group to include a disclosure requirement in international industrial design applications. Up to now the stumbling block preventing delegates from moving to a high-level treaty negotiation has been technical assistance. This additional parameter might come in the way of swift agreement.
