Taiwan IP Office Moves Beyond Politics To Forge Links With Other IP Offices, Enforce IP Rights

TAIPEI, Taiwan -- The building is impressive. Taiwan’s intellectual property office, located in the Dan-an district of Taipei, deals with patents, trademarks, designs, and utility models. Not being a recognised member of the United Nations, Taiwan cannot access the World Intellectual Property Organization treaties, in particular the Patent Cooperation Treaty. However, Taiwan is dedicated to enforcing IP rights, and entertains agreements with several IP offices in the world, including China, which is Taiwan's major trading partner.

UAEM Students Launch Campaign To Drop Publicly Funded Patent Claim On Cancer Drug In India

The Universities Allied for Essential Medicines (UAEM) this week launched a campaign to ask the University of California to drop its pursuit of a patent on the prostrate cancer drug Xtandi in India in order to make it affordable for patients. Xtandi sells at "exorbitant" rates in the United States, they said, a seeming violation of the licensing guidelines of the publicly funded University of California system which guarantees an "appropriate" return on taxpayer investments.

Indian Pharma Industry Disputes US Industry IP Index

The United States Chamber of Commerce industry group recently issued its annual global IP index, analysing intellectual property protection in 50 countries, as a prelude to the annual US government list of countries seen as not adequately protection US companies' IP rights. Now an Indian industry group has issued a counter-statement to the Chamber index, calling it a "tirade" and "self-serving".

JPO Refused To Register Wordmark “ROMEO GIGLI” Due To Lack Of Consent From Italian Fashion Designer

In a recent decision, the Appeal Board of Japan Patent Office (JPO) refused to register trademark application no. 2015- 100245 for a red-colored word mark “ROMEO GIGLI” in gothic script (see below) designating goods of Class 24 and 25 on the grounds that applicant failed to obtain a consent from Italian fashion designer, Romeo Gigli, based on Article 4(1)(viii) of the Trademark Law, writes Masaki Mikami.

In a decision in an invalidation trial jointly claimed by INSTITUT NATIONAL DE L’ORIGINE ET DE LA QUALITE and CONSEIL INTERPROFESSIONNEL DU VIN DE BORDEAUX, the Invalidation Board of Japan Patent Office (JPO) ordered the invalidation of trademark registration no. 5737079 for a word mark “Bord’or” in script fonts (see below) in violation of Article 4(1)(vii) of the Trademark Law, writes Masaki Mikami.
